Ataraxia Ltd is the operator and owner of the www.oddjobmarket.co.uk website and Facebook application apps.facebook.com/jobsdone (when branded as Oddjobmarket for the UK) (together "Oddjobmarket"). Oddjobmarket is a marketplace and contact network website and application for registered users to offer, sell and purchase all types services to/from buyers/sellers in the United Kingdom of Great Britain and Northern Ireland, Isle of Man, Jersey, Guernsey and Alderney ("Jobs"). The registered users warrant that the sale and/or purchase of the services is not in any way contrary to the laws of the UK (or any other relevant jurisdiction) and does not infringe the terms of this Terms of Use agreement. Oddjobmarket shall not be liable for any breaches that do occur.

These Terms of Use incorporate the Privacy Policy, Website Rules and DMCA Notice on this website.

Ataraxia Ltd is a company with limited liability registered in the Isle of Man under company number 111832C and registered for Value Added Tax in the United Kingdom and the Isle of Man under VAT number GB 003 3177 25. The registered address of the company is 9 Kensington Road, Douglas, Isle of Man, IM1 3ER.

All purchase and sale agreements are solely between the buyer and seller of the services. Oddjobmarket is not a party to the contract between the buyer and seller, Oddjobmarket is merely the provider of a marketplace.

Only registered users can use Oddjobmarket to purchase, post, offer, sell and enquire about Jobs and Wanted Jobs. Registration is free for all users.

Jobs can be posted on Oddjobmarket starting at £5.00 and only at full Pounds.

Jobs can be either paid in cash between the buyer and seller ("Cash Payment") or credit card, debit card, online or bank transfer payment ("Secure Payment").

The seller can enable or disable Cash Payment and Secure Payment transactions for each Job.

Private individuals and companies, based nationally and abroad, can register as users on Oddjobmarket.

Users are prohibited from taking and/or offering any payment for Jobs unless either (a) the Secure Payment runs entirely via Oddjobmarket and the Job was ordered on Oddjobmarket, or (b) the job is declared a Cash Payment by both buyer and seller at the beginning of the enquiry.

With Secure Payment transactions the buyer pays the full price for the Job to Oddjobmarket in advance when placing the order.

With Cash Payment transactions the buyer and seller arrange payment bilaterally.

There are no costs to the buyer for using the Oddjobmarket marketplace website system.

With Secure Payment transactions when the Job has been delivered, completed or produced respectively, the agreed price for the Job will be credited to the seller's Oddjobmarket account after 10 (ten) business days.

• One-time Jobs:
  • 15 (fifteen) percent of the agreed price for the Job including Value Added Tax, bank transfer fees,
    credit card charges, debit card charges and online payment charges
• Recurring Jobs:
  • 20 (twenty) percent of the agreed price for the Job including Value Added Tax, bank transfer fees,
    credit card charges, debit card charges and Paypal charges for the first Recurring Job carried out for a new buyer
  • 10 (ten) percent of the agreed Job price including Value Added Tax, bank transfer fees, credit card charges,
    debit card charges and online payment charges for all additional recurring Jobs carried out for an existing buyer

For Cash Payment transactions the seller pays a lead generation fee ("Lead Fee"). A Lead Fee is due as soon as a potential buyer sends an enquiry for the Job to the seller that is stipulated to be transacted in cash. A Lead Fee is charged irrespective of the successful conclusion of the transaction and is charged by the purchase of tokens that can be bought on Oddjobmarket's Premium store.

When selling a Job on Oddjobmarket sellers must agree with the buyer a delivery period (in days) within which period the Job will be fully completed ("Delivery Period"). This is the deadline for the Job and once a buyer has placed an order the deadline cannot be varied without the written consent of the buyer. If this deadline is passed the buyer will have the right to cancel the order.

By entering a Job on Oddjobmarket the seller confirms that he is in possession of any legal rights required to carry out the Job or to produce the goods. Furthermore, the seller warrants that he/she has the necessary skills, qualifications, certification, licence and/or authority to offer or sell the Job and to transfer any ownership, licence and/or usage rights as appropriate.

In the case that the Job is copyrighted material, the seller transfers to the buyer the exclusive, unlimited, transferable usage rights, including the right to sub-license, with the sale of the Job. Such usage rights include the right to duplication, distribution, public performance, public display and public access to the Job in all known media and forums, including the right to amend and further develop the Job, as well as the rights to use the products created by such amendment or development in all forms listed herein.

The seller forfeits the right to be listed as the original artist or creator of the Job and any intellectual property rights that are created shall vest in the buyer.

When a Job is accepted by a buyer the seller will be advised by email.

Sellers are obligated to carry out the Job within the Delivery Period. In the event of the Job not being completed within the Delivery Period the buyer can cancel the Job. (The reputation points of the seller on Oddjobmarket will be correspondingly downgraded.)

A buyer can cancel a Job at any time. (The reputation points of the buyer on Oddjobmarket will be correspondingly downgraded.)

Buyer and seller can cancel a Job by mutual agreement. (The reputation points of the buyer and the seller on Oddjobmarket will not be downgraded.)

Unanswered cancellation requests will be automatically accepted after 48 hours. (The reputation points of the silent party on Oddjobmarket will be correspondingly downgraded.)

In the event of the cancellation of a Job (for whatever reason) the price transferred to Oddjobmarket by the buyer will be recredited by Oddjobmarket to the buyer's Oddjobmarket account. Oddjobmarket does not refund payments to Paypal or the bank; refunds are credited to the buyer's account with Oddjobmarket to be used for future purchases.

The reputation points of the seller are based on feedback from the buyer, any cancelled Jobs, delayed deliveries and any other actions affecting reputation points ("RP") as indicated on the Oddjobmarket website.

The buyer will be the owner of all rights to the delivered Job unless any rights are specifically excluded in the Job description by the seller, or such a transfer of rights is not legally possible.

Sellers are responsible for the arranging of any necessary insurances (accident and liability insurance, for example) and for the payment of any taxes and welfare contributions. Neither the buyer nor Oddjobmarket have any responsibility in these respects.

Oddjobmarket will on request provide information regarding Jobs, financial data and personal data of sellers and users to tax authorities and other government departments.

Sellers are themselves responsible for checking all data sent or received via the Internet for viruses and malware including web addresses provided.

Oddjobmarket accepts no liability for any damages that may be caused by the use of the website or its contents or by data or files sent and received howsoever arising.

The seller must report Job deliveries via the "Job delivery" function on the Oddjobmarket order page.

Buyers have three days following the registration of a Job delivery to confirm the delivery via the "Job delivery" function. After three days the Job will automatically be marked as delivered.

Buyers can pay for Jobs as a Secure Payment by debit card, credit card, via Paypal or Google Checkout, by bank transfer or using Oddjobmarket credits, or as a Cash Payment directly to the seller.

If a user's Oddjobmarket credit is sufficient to pay for a Job it will automatically be used for a new Job order.

Orders for Jobs will become definite as soon as the buyer confirms the order.

Oddjobmarket is not responsible for any loss arising directly or indirectly as a result of Oddjobmarket's management of a registered user's account or a Job.

Oddjobmarket accepts no responsibility for checking that the seller is able to perform the Job or that the Job has been performed to a satisfactory standard or at all.

Buyers and sellers may neither accept nor make any financial transfers other than via the Oddjobmarket payment system unless both buyer and seller elect (at their own risk) for a Cash Payment.

Buyers may not pay sellers directly unless both buyer and seller elect (at their own risk) for a Cash Payment. Any request or demand made by a user for an alternative payment method must be immediately notified to Oddjobmarket via the website or by email.

Buyers and sellers should use their best endeavours to solve any possible conflicts bilaterally. If this is not possible representatives of Oddjobmarket's customer service will for Secure Payments provide advice to assist in the resolution to the extent that they shall in their absolute discretion deem appropriate. This advice will be charged at £5.00 (five Pounds Sterling) (inclusive of any VAT) per required instance ("Advice Fee"), to be deducted from the funds held by Oddjobmarket on behalf of the buyer and seller. Both buyer and seller agree to the deduction of the Advice Fee.

Legitimate cancellation of orders can be authorised via the customer service of Oddjobmarket up to 10 (ten) business days after the delivery of the order. Oddjobmarket cannot accept responsibility for cancelling any orders after this time.

Users are requested not to initiate any disputes on Paypal, Google Checkout, with credit card companies or the user's bank, nor to ask for any payment refunds without first having attempted to resolve the issues using Oddjobmarket's customer service; such disputes can be resolved more quickly and at less expense via Oddjobmarket. Oddjobmarket reserves the right to block accounts in cases where users initiate such disputes.

Oddjobmarket users' identities remain anonymous, unless the seller opts to allow a buyer to provide telephone number or email address for contact purposes and buyer takes up this opportunity ("Direct Contact"). Otherwise it is possible only after a Job has been ordered that personal information which is necessary for the Job to be carried out may be exchanged.

For Direct Contact transactions the seller pays a direct contact fee ("Direct Contact Fee"). A Direct Contact Fee is due as soon as a potential buyer sends Direct Contact details for the Job to the seller. A Direct Contact Fee is charged irrespective of the successful conclusion of the transaction and is charged by the purchase of tokens that can be bought on Oddjobmarket's Premium store.

Certain Oddjobmarket Jobs require physical delivery. In such cases the delivery costs must be included in the price and agreed between buyer and seller. The seller is responsible for all aspects of the delivery.

Oddjobmarket has no involvement in the delivery, the following up, the quality or the condition of products or services, and provides no guarantees. Oddjobmarket has no responsibility and no liability for any direct or indirect problems arising in connection with the despatch or delivery of Jobs.

Certain Oddjobmarket Jobs are services or goods which are offered at the place of the buyer, the seller, or at another location. Buyers and sellers are themselves responsible agreeing which of them shall be responsible for arranging and/or paying for travel expenses, personal health and safety, loss of or damage to goods, and insurance.

Oddjobmarket has no responsibility for the location where services or goods may be delivered, nor for the quality of services or goods, and provides no guarantees in these respects. Oddjobmarket has no responsibility and no liability for any direct or indirect problems arising in connection with the services or goods.

In the event of a user finding a Job on Oddjobmarket for which the offer, the distribution/sale, or the acquisition is illegal in the UK or not in accordance with these Terms of Use, this can be notified to Oddjobmarket as a possible illegal or copyright infringement by pressing the "Report" button on the website. This method of notification is restricted to registered users only and the notification includes the identity of the member.

The pressing of the Report button results in the Job offer being removed from Oddjobmarket until Oddjobmarket has completed its investigations. After investigation the Job will either be deleted or reinstated in the system. For Jobs which have been notified, investigated and reinstated the Report button is deactivated.

Income is available after a period of 14 (fourteen) days after being credited to the Oddjobmarket account.

In order to make withdrawals from their Oddjobmarket account balance, users of Oddjobmarket must have a Paypal account or a bank account registered with Oddjobmarket.

Each Oddjobmarket user's profile requires a connection with a Paypal account and/or a bank account. This connection is on-going and cannot be amended.

The payout of Oddjobmarket account balances are subject to an administration fee of £2.00 (two Pounds Sterling) (inclusive of VAT) and can be made via PayPal or UK bank transfer. Any other payment options may generate additional administration fees and costs. Such fees and costs will be advertised.

Payouts of Oddjobmarket balances are final and cannot be reversed.

Sellers can withdraw income from a blocked account only after a period of 45 to 90 days, this period depending on the reason for the account blocking. This period commences the day after the last authorised payment to the account. Such a withdrawal requires the authorisation of Oddjobmarket.

Oddjobmarket reserves the right to temporarily or permanently suspend or cancel any account in the event of wrongdoing. Users whose accounts have been suspended or cancelled can neither buy nor sell via Oddjobmarket.

Oddjobmarket reserves the right to amend these Terms of Use at any time. The latest Terms of Use are available on the website at http://www.oddjobmarket.co.uk/terms-of-use.php.

Users agree to the latest Terms of Use by using Oddjobmarket after the date of any amendment of these Terms of Use.

These Terms of Use are construed under the laws of England and Wales and the parties agreed to the sole jurisdiction of the Cambridge County Court, Cambridge, England.

A breach of the Terms of Use of Oddjobmarket can result in the permanent blocking of an account.

If any provision in these Terms of Use is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from the Terms of Use and rendered ineffective as far as possible without modifying the remaining provisions of the Terms of Use and shall not in any way affect any other circumstances of or the validity or enforcement of the Terms of Use.
